1. Counsel for both the sides are present.
2. The Applicant who is working as Sub Post Master, Assam Sachivalay MDG, has been given a punishment of recovery of Rs.9,63,908/- and stoppage of one increment for one year in a departmental enquiry. It is contended by the counsel for the Applicant that Applicant’s appeal, which was filed on 12.09.2017 before the Director of Postal Services (Respondent no.3) has still not been decided, and it is his prayer that a time bound direction to the appellate authority to decide the appeal of the Applicant be given.
3. We have perused the case. The appeal is pending since over four months, therefore, it seems appropriate that the appellate authority be directed to dispose of the appeal pending before him within six weeks from the date of receipt of a certified copy of this order by passing a reasoned and speaking order. Copy of the order passed by the appellate authority may be delivered to the Applicant immediately thereafter. Needless to add that the above direction should not be construed as our opinion on the merits of this case.
4. This takes care of one of the relief(s) claimed by the Applicant. As the charge memo has already r
