Notwithstanding the Opposite Party having been duly served with a notice, it has not chosen to enter appearance or file any statement of objections. The Complainant has filed his sworn affidavit in support of the averments contained in the complaint petition. We accept the averments contained in the affidavit and hold that the Complainant has made out his claim for reliefs as against the Opposite Party. Accordingly we direct that the Opposite Party shall refund to the Complainant the full amount of Rs. 8,55,000/- which had been deposited with the Opposite Party by the Complainant with interest at 18% per annum from the date on which the amount was deposited in different instalments.
